TERMS OF SERVICE – GRÜNWASCHEN

OVERVIEW

Welcome to GRÜNWASCHEN. The terms “we”, “us” and “our” refer to Uroš Kramberger, Alfred-Kowalke-Str. 30, 10315 Berlin, Germany, operating the store under the name GRÜNWASCHEN, Rosa-Luxemburg-Str. 25, 10178 Berlin, Germany (“GRÜNWASCHEN”).

GRÜNWASCHEN operates this online store and website, including the related information, content, features, products and services (the “Services”). Our online store is powered by Shopify.

These Terms of Service (“Terms”), together with the policies referenced below, govern your use of our website and purchases made through our online store.

Please read these Terms carefully before using our Services or placing an order. Nothing in these Terms limits any mandatory rights you may have as a consumer under German or applicable EU law.

SECTION 1 – ACCESS AND ACCOUNT

You may use our online store only if you are legally capable of entering into the relevant contract or are acting with the required consent of your legal representative.

When using our Services or placing an order, you may be required to provide information including your name, email address, billing address, shipping address and payment information.

You are responsible for ensuring that the information you provide is current, complete and accurate.

If you create a customer account, you are responsible for keeping your login credentials confidential and for activity carried out through your account.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to describe and display our products accurately. However, colours and appearance may vary slightly depending on your screen, device and display settings.

Many products offered by GRÜNWASCHEN are produced by independent designers, in small quantities, by hand, through upcycling or using individual production techniques. Minor variations between individual pieces may therefore occur and do not necessarily constitute a defect.

Product availability may change at any time. We reserve the right to limit quantities, discontinue products or restrict the countries or regions in which particular products are offered.

SECTION 3 – ORDERS AND CONTRACT FORMATION

The presentation of products in our online store does not constitute a legally binding offer but an invitation to place an order.

By submitting an order through the checkout, you make a binding offer to purchase the products contained in your order.

After your order has been submitted, you will normally receive an automated order confirmation by email. A purchase contract is concluded when we expressly accept your order or dispatch the goods.

We reserve the right to decline or cancel an order where there is a legitimate reason to do so, for example where a product is no longer available, payment cannot be processed, incorrect information has been provided or an obvious pricing error has occurred.

If we cannot accept your order after payment has already been made, the relevant payment will be refunded.

SECTION 4 – PRICES, VAT AND PAYMENT

Prices displayed to consumers in our online store are total product prices. As a small business within the meaning of Section 19 of the German VAT Act (UStG), we do not charge German VAT on transactions covered by this provision.

Shipping costs, where applicable, are shown separately during checkout before the order is submitted.

Prices, promotions and discounts may change from time to time. The price applicable to your order is the price displayed during checkout when the order is placed.

Available payment methods are displayed during checkout. You are responsible for providing complete and accurate payment and billing information.

For deliveries outside the European Union, additional customs duties, import taxes, handling charges or other fees may be imposed by customs authorities, carriers or other third parties. These charges are not collected by GRÜNWASCHEN during checkout and, where applicable, must be paid separately by the customer.

SECTION 5 – SHIPPING AND DELIVERY

We ship only to countries and destinations currently made available through our online store. Availability of shipping to a particular country may change from time to time.

Germany: Standard shipping is free for orders delivered within Germany.

European Union: For EU countries to which we currently offer delivery, shipping is free for orders with a product value of €200 or more. For orders below €200, the applicable shipping cost is calculated and shown during checkout.

Other countries: Where international delivery is available, shipping costs are calculated and shown during checkout.

We may use different carriers or shipping providers depending on the destination, parcel, product, availability or operational requirements. We do not guarantee that every order will be shipped with the same carrier.

Delivery times shown in our online store are estimates unless a delivery date has expressly been guaranteed. Delays may occur due to carriers, customs, public holidays, weather, force majeure or other circumstances outside our reasonable control.

For consumer purchases, the risk of accidental loss or damage generally passes to you when the goods are delivered to you or to a person designated by you. Mandatory statutory rules remain unaffected.

SECTION 6 – WITHDRAWAL, RETURNS AND REFUNDS

If you are a consumer, you may have a statutory right to withdraw from an online purchase within 14 days in accordance with applicable law.

Returns from Germany are free. After you submit a return request and the return has been confirmed by us, GRÜNWASCHEN will provide a prepaid return label.

For returns sent from countries outside Germany, the customer is responsible for the direct cost of return shipping, unless the item is defective, incorrectly supplied or we are otherwise legally required to cover the cost.

Nothing in these Terms limits your statutory rights regarding defective, damaged or incorrectly supplied goods.

SECTION 7 – RETENTION OF TITLE

Goods remain our property until payment has been made in full.

SECTION 8 – STATUTORY WARRANTY RIGHTS

Your statutory warranty rights under applicable law apply to all purchases.

Nothing in these Terms excludes or restricts statutory consumer rights that cannot legally be excluded or restricted.

SECTION 9 – INTELLECTUAL PROPERTY

The content of our website, including texts, photographs, graphics, videos, designs and other materials, is protected by applicable copyright, trademark and intellectual property laws.

Unless otherwise permitted by law, such content may not be reproduced, distributed, modified, republished or commercially used without the prior permission of the relevant rights holder.

Product photographs, texts, trademarks and designs belonging to independent designers or other third parties remain the property of their respective rights holders.

SECTION 10 – THIRD-PARTY SERVICES AND LINKS

Our online store may use services provided by third parties, including Shopify, payment providers, analytics services, marketing services and shipping providers.

Our website may also contain links to external websites. We are not responsible for the content, availability or data protection practices of independent third-party websites.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

Our online store is operated using Shopify technology. However, purchase contracts for products sold through GRÜNWASCHEN are concluded directly with GRÜNWASCHEN and not with Shopify.

Shopify is therefore not the seller of products purchased from GRÜNWASCHEN.

SECTION 13 – REVIEWS, COMMENTS AND FEEDBACK

If you voluntarily submit reviews, comments, photographs or other feedback, you confirm that you have the necessary rights to provide that content and that the content does not violate applicable law or the rights of third parties.

Where permitted by law, you grant us the right to use such content for the operation and presentation of our business and Services, including on our website and social media channels.

We may remove content that is unlawful, abusive, misleading or infringes the rights of others.

SECTION 14 – ERRORS AND AVAILABILITY

Despite reasonable care, our website may occasionally contain typographical errors, incorrect availability information, technical errors or other inaccuracies.

We may correct such errors and update information where necessary. If an error materially affects an order already placed, we will contact you and your statutory rights remain unaffected.

You may use our Services only for lawful purposes.

You must not use our website to violate applicable law or third-party rights, distribute malware or harmful code, interfere with the security or operation of our Services, gain unauthorised access to systems or engage in fraudulent activity.

We may restrict access to our Services where reasonably necessary to prevent unlawful activity, misuse or security risks.

SECTION 16 – LIABILITY

We are liable without limitation for damage caused intentionally or by gross negligence and for damage resulting from injury to life, body or health where required by law.

In cases of slight negligence, we are liable for the breach of essential contractual obligations only to the extent of foreseeable damage typical for the relevant contract.

Mandatory liability, including liability under applicable product liability law, remains unaffected.

SECTION 17 – SEVERABILITY

If any provision of these Terms is invalid or unenforceable, the validity of the remaining provisions is not affected. The applicable statutory provision will apply in place of the invalid provision where required.

SECTION 18 – GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer habitually resident in another EU country, mandatory consumer protection provisions of your country of residence remain applicable.

If you are a merchant (Kaufmann) within the meaning of German commercial law, the exclusive place of jurisdiction, where legally permitted, is Berlin, Germany.

SECTION 19 – CHANGES TO THESE TERMS

The current version of these Terms can be viewed on this page at any time.

We may update these Terms for future use where reasonably necessary, for example due to changes in law, our Services or our business operations. Changes do not affect rights and obligations arising from orders already concluded unless permitted by applicable law.
