Welcome to GRÜNWASCHEN! The terms “we”, “us” and “our” refer to Uroš Kramberger, Alfred-Kowalke-Str. 30, 10315 Berlin, Germany, operating the store under the name GRÜNWASCHEN, Rosa-Luxemburg-Str. 25, 10178 Berlin, Germany (“GRÜNWASCHEN”).
GRÜNWASCHEN operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). GRÜNWASCHEN is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”), together with any policies referenced herein (including our Privacy Policy and Return & Refund Policy), describe your rights and responsibilities when you use the Services.

When you place an order, you are making an offer to purchase. GRÜNWASCHEN reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until GRÜNWASCHEN confirms acceptance (for example, via order confirmation email). We must receive and successfully process your payment before your order is accepted.
Please review your order carefully before submitting, as GRÜNWASCHEN may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel an order, we will attempt to notify you by contacting the email address and/or phone number provided at the time the order was made.
Your purchases are subject to return or refund solely in accordance with our Return & Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices posted in our online store may be different from prices offered in physical stores or by other retailers. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by separate terms and conditions. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You represent and warrant that (i) any payment information you provide is true, correct and complete, (ii) you are duly authorized to use such payment method, and (iii) charges incurred by you will be honored by your payment provider.
SECTION 5 – SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays caused by carriers, customs, or events outside our reasonable control. All delivery times are estimates only and are not guaranteed, unless explicitly stated otherwise.
Once we transfer products to the carrier, risk of loss passes to you. Your statutory rights in the event of delay or non-delivery remain unaffected.

The Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by GRÜNWASCHEN, its affiliates or licensors and are protected by copyright, trademark and other intellectual property laws.
You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent, except as may be permitted under applicable law for private use.
GRÜNWASCHEN’s names, logos, product and service names, designs, and slogans are trademarks of GRÜNWASCHEN or its affiliates or licensors. You must not use such trademarks without our prior written permission. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify Inc. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
SECTION 7 – OPTIONAL TOOLS
You may be provided with access to tools or functionality offered by third parties as part of the Services, which we neither monitor nor control.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the Services is entirely at your own risk and discretion and you should ensure that you are familiar with, and agree to, the terms on which tools are provided by the relevant third-party provider(s).

SECTION 9 – RELATIONSHIP WITH SHOPIFY
GRÜNWASCHEN is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with GRÜNWASCHEN. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and GRÜNWASCHEN, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with GRÜNWASCHEN.
SECTION 10 – PRIVACY POLICY

Occasionally there may be information in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order). Your statutory rights remain unaffected.

To the fullest extent permitted by law, GRÜNWASCHEN and its affiliates shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Services or any products purchased through the Services.
Our liability for slight negligence shall be limited to foreseeable damages typical for this type of contract. Nothing in these Terms shall exclude or limit liability for intent, gross negligence, injury to life, body or health, or any other liability that cannot be excluded under applicable law.
SECTION 17 – INDEMNIFICATION
If you use the Services in a way that causes us damage or leads to claims from third parties, you agree to indemnify and hold harmless GRÜNWASCHEN from any such claims, to the extent permitted by applicable law.
SECTION 18 – SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms, together with our policies (including the Privacy Policy and Return & Refund Policy), constitute the entire agreement between you and us relating to the use of the Services.
SECTION 20 – ASSIGNMENT
You may not transfer or assign any of your rights or obligations under these Terms without our prior written consent. We may transfer or assign our rights and obligations under these Terms to another entity, in particular in connection with a business restructuring or sale.
SECTION 21 – GOVERNING LAW AND JURISDICTION
These Terms and any disputes arising out of or in connection with them shall be governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer with your habitual residence in the European Union, you may also benefit from mandatory provisions of the law of your country of residence, and you may bring claims in the courts of your place of residence.
If you are a merchant (Kaufmann) under German law, the exclusive place of jurisdiction for all disputes shall be Berlin, Germany.

Diese Allgemeinen Geschäftsbedingungen („AGB“) gelten für alle Bestellungen, die Sie als Verbraucher über unseren Online-Shop tätigen, sowie für die Nutzung unserer Website und Services („Services“). Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, wir stimmen ihrer Geltung ausdrücklich zu.
Ihre gesetzlichen Rechte als Verbraucher nach deutschem und EU-Recht werden durch diese AGB nicht eingeschränkt.
2. Nutzung des Online-Shops / Konto
Mit Nutzung unseres Online-Shops bestätigen Sie, dass Sie volljährig sind oder mit Zustimmung Ihrer gesetzlichen Vertretung handeln.

4. Bestellablauf und Vertragsschluss
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Abgabe einer Bestellung.
Durch Anklicken des „Kaufen“-Buttons geben Sie ein verbindliches Angebot zum Kauf der im Warenkorb befindlichen Waren ab. Die Bestätigung des Zugangs Ihrer Bestellung erfolgt unmittelbar nach dem Absenden per E-Mail. Ein Vertrag kommt erst zustande, wenn wir Ihre Bestellung ausdrücklich annehmen oder die Ware versenden.
Sollten wir eine Bestellung nicht annehmen oder stornieren müssen, informieren wir Sie per E-Mail.

5. Preise, Zahlung und Rechnungsstellung
Alle Preise im Online-Shop verstehen sich inklusive der jeweils gültigen gesetzlichen Mehrwertsteuer (sofern anwendbar), zzgl. Versandkosten, sofern nicht anders angegeben.
Es gelten die Preise zum Zeitpunkt der Bestellung. Etwaige Aktionspreise oder Rabatte können zeitlich begrenzt sein. Zahlungsarten und -bedingungen werden im Bestellprozess angezeigt.
Sie verpflichten sich, aktuelle, vollständige und korrekte Zahlungsdaten bereitzustellen und uns über Änderungen unverzüglich zu informieren.
6. Versand, Lieferung und Gefahrübergang
Informationen zu Versandkosten, Lieferzeiten und belieferte Länder finden Sie in unserer Versandübersicht.
Lieferzeiten sind, sofern nicht ausdrücklich zugesichert, unverbindliche Richtwerte. Verzögerungen können insbesondere durch den Versanddienstleister, Zoll oder höhere Gewalt entstehen.
Mit Übergabe der Ware an den Versanddienstleister geht die Gefahr des zufälligen Verlustes und der zufälligen Verschlechterung auf Sie über, soweit Sie nicht Verbraucher sind. Für Verbraucher gilt die Gefahr erst mit Übergabe der Ware an Sie.
7. Eigentumsvorbehalt
Bis zur vollständigen Bezahlung bleibt die gelieferte Ware unser Eigentum.
8. Widerrufsrecht und Rückgabe
Als Verbraucher steht Ihnen das gesetzliche Widerrufsrecht nach Maßgabe unserer Widerrufsbelehrung zu.

9. Geistiges Eigentum

Die Marken, Namen und Logos von GRÜNWASCHEN dürfen ohne unsere vorherige schriftliche Zustimmung nicht verwendet werden. Shopify ist eine eingetragene Marke von Shopify Inc.

Wir nutzen Dienstleistungen und Tools von Drittanbietern (z. B. Shopify, Zahlungsdienstleister, Analyse- und Marketing-Tools). Zudem können unsere Services Links zu externen Websites Dritter enthalten.
Für Inhalte, Funktionsweise und Datenschutz auf Seiten Dritter übernehmen wir keine Haftung. Es gelten die jeweiligen Bedingungen und Datenschutzerklärungen der Drittanbieter.
11. Beziehung zu Shopify
Unser Online-Shop wird über Shopify betrieben. Ihre Kaufverträge schließen Sie jedoch ausschließlich mit Uroš Kramberger / GRÜNWASCHEN ab.
Shopify ist nicht Vertragspartner Ihrer Bestellungen und nicht verantwortlich für die Erfüllung unserer vertraglichen Pflichten oder etwaige Schäden aus dem Kaufvertrag. Etwaige Ansprüche aus oder im Zusammenhang mit Ihrem Kauf sind ausschließlich gegenüber GRÜNWASCHEN geltend zu machen.
12. Kundenbewertungen und Feedback
Wenn Sie Bewertungen, Kommentare oder sonstiges Feedback abgeben, räumen Sie uns ein einfaches, zeitlich und räumlich unbeschränktes Nutzungsrecht ein, diese Inhalte zum Zwecke des Betriebs, der Darstellung und Vermarktung unseres Shops zu verwenden (z. B. auf der Website, in Social Media).
Sie sind dafür verantwortlich, dass Ihre Inhalte keine Rechte Dritter verletzen (z. B. Urheberrechte, Persönlichkeitsrechte) und nicht gegen geltendes Recht verstoßen.
Wir behalten uns vor, Inhalte zu entfernen, die rechtswidrig, beleidigend oder unzulässig sind.
13. Haftung
Ansprüche auf Schadensersatz sind ausgeschlossen, soweit nachfolgend nichts anderes bestimmt ist.
Wir haften unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer vorsätzlichen oder fahrlässigen Pflichtverletzung von uns beruhen.
Für sonstige Schäden haften wir nur bei Vorsatz und grober Fahrlässigkeit. Bei einfacher Fahrlässigkeit haften wir nur bei Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht); in diesem Fall ist die Haftung auf den vorhersehbaren, vertragstypischen Schaden begrenzt.
Die vorstehenden Haftungsbeschränkungen gelten auch zugunsten unserer gesetzlichen Vertreter und Erfüllungsgehilfen.
Zwingende Haftung nach dem Produkthaftungsgesetz bleibt unberührt.
14. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte. Angaben zu Produkten (z. B. Maße, Farben) sind im Rahmen des Zumutbaren als Annäherungswerte zu verstehen; unwesentliche Abweichungen begründen keinen Mangel.
15. Verbotene Nutzungen
Sie dürfen unseren Online-Shop und unsere Services nur in Übereinstimmung mit geltendem Recht nutzen und insbesondere nicht:

18. Anwendbares Recht und Gerichtsstand
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG).
Sind Sie Verbraucher mit Wohnsitz in der EU, gilt zusätzlich das zwingende Verbraucherschutzrecht Ihres Wohnsitzstaates; Sie können Ansprüche vor den Gerichten Ihres Wohnsitzstaates oder in Deutschland geltend machen.
Sind Sie Kaufmann im Sinne des HGB, ist ausschließlicher Gerichtsstand für alle Streitigkeiten Berlin.
19. Salvatorische Klausel
Sollten einzelne Bestimmungen dieser AGB ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Anstelle der unwirksamen Bestimmung tritt die gesetzliche Regelung.
